BY DOWNLOADING, ACCESSING, OR USING THE APP, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, YOU MUST IMMEDIATELY DISCONTINUE USE OF THE APP.

1. ELIGIBILITY

You must be at least 18 years of age to create an account. By using Hoot Me, you represent and warrant that:

You have the legal capacity to form a binding contract.
You have never been convicted of a felony or a sex crime.
You are not a person barred from using the Services under the laws of any applicable jurisdiction.

2. ACCOUNT REGISTRATION & VERIFICATION

Accuracy: You must provide accurate, current, and complete information during registration.
Verification: To enhance community safety, Hoot Me requires identity verification, which may include Government ID copies and/or Gesture Selfies. We reserve the right to deny access to any user who fails our verification process.
Security: You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

3. THE NATURE OF THE SERVICE

Hoot Me is a social platform that facilitates the discovery and creation of real-world events (e.g., clubbing, road trips, dining, sports). HOOT ME IS A VENUE, NOT AN ORGANIZER. We do not organize, host, or control the events listed on the App. We do not vet every user beyond our basic verification protocols.

4. USER CONDUCT & PROHIBITED ACTIVITIES

You agree not to use the App to:

Violate any local, state, national, or international law.
Harass, bully, stalk, or intimidate other users.
Post "Events" that involve illegal activities, commercial solicitation, or sexual services.
Create fake profiles or misrepresent your identity.
Scrape, hack, or attempt to disrupt the App's infrastructure.

5. SAFETY & PHYSICAL INTERACTION (CRITICAL DISCLOSURE)

USER INTERACTS WITH STRANGERS AT THEIR OWN RISK.

Public Places: Hoot Me strictly advises and requires that all initial meetings between users occur in public, well-populated places (e.g., restaurants, parks, stadiums).
No Background Checks: While Hoot Me uses verification tools, we do not perform comprehensive criminal background checks on our users.
Personal Responsibility: You are solely responsible for your safety. We recommend informing friends or family of your location before attending any Hoot Me event.
No Liability for Offline Conduct: Hoot Me is not responsible for the actions of any user, whether online or offline.

6. EVENT CREATION & CONTENT

By posting content (photos, event descriptions) on Hoot Me, you grant us a non-exclusive, royalty-free, worldwide license to use, display, and distribute said content. You represent that you own all rights to the content you post.

7. FEES AND PAYMENTS

Hoot Me currently offers [Free/Freemium] services. We reserve the right to introduce subscription fees or "premium event" charges in the future. All payments are non-refundable unless required by local law.

8. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOOT ME AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO:

Personal injury, death, or emotional distress resulting from meetings coordinated via the App.
Loss of data or theft of property during an event.
Unauthorized access to your personal information.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS SHALL NOT EXCEED $100 USD (OR LOCAL EQUIVALENT).

9. INDEMNIFICATION

You agree to indemnify and hold harmless Hoot Me and its officers from any claims, damages, or legal fees arising out of your breach of these Terms, your conduct during an event, or your violation of any third-party rights.

10. TERMINATION

We reserve the right to suspend or terminate your account at our sole discretion, without notice, for any violation of these Terms or for conduct that we deem harmful to the Hoot Me community.

11. GOVERNING LAW & DISPUTE RESOLUTION

Governing Law: These Terms are governed by the laws of [Insert Country/State, e.g., Delaware, USA].
Arbitration: Any dispute arising from these Terms shall be resolved through final and binding arbitration, rather than in court, except for small claims court if applicable.
Class Action Waiver: You agree to resolve disputes with Hoot Me on an individual basis and waive any right to participate in a class-action lawsuit.

12. INTERNATIONAL USE

As Hoot Me is available globally, you agree to comply with all local rules regarding online conduct and acceptable content in the country in which you reside.

13. MODIFICATIONS TO TERMS

We may modify these Terms at any time. We will notify you of material changes via the App or email. Your continued use of the App after changes are posted constitutes your acceptance of the new Terms.
